Acceptable Use Policy

The content and conduct rules for BananaImage, including our strict prohibition of NSFW, pornographic, and sexually explicit image generation.

This Acceptable Use Policy ("AUP") governs your use of BananaImage (the "Service") and applies to all prompts, reference images, uploads, and generated outputs. It is incorporated into our Terms of Service by reference. By using the Service, you agree to this AUP. If you do not agree, do not use the Service.

1. Strictly Prohibited Content

1.1 No NSFW, Pornographic, or Sexually Explicit Content — Zero Tolerance

You must not use the Service to generate, request, upload, edit, or distribute any NSFW (not safe for work), pornographic, or sexually explicit content. This prohibition is absolute and applies in all cases, including:

  • Depictions of sexual acts, sexual activity, or sexualized poses, whether real or simulated.
  • Depictions of full or partial nudity intended to be erotic or sexually suggestive.
  • Sexually explicit or suggestive depictions of any person, whether real, fictional, AI-generated, photorealistic, cartoon, anime, or otherwise stylized.
  • Content intended to arouse sexual gratification, including fetish content, eroticized imagery, and "adult" content of any kind.
  • Attempts to use image-to-image editing, inpainting, outpainting, face-swapping, or similar tools to undress, sexualize, or create intimate depictions of any person.

There are no exceptions for "artistic", "educational", or "private" use. All sexually explicit and NSFW generation is prohibited on this Service.

1.2 Child Sexual Abuse Material (CSAM) and Sexualization of Minors

You must not generate, request, upload, or distribute any content that sexualizes or exploits minors in any way, including any sexual or suggestive depiction of a person who is, appears to be, or is represented as being under 18 years old. We treat such content as CSAM. We report suspected CSAM to the relevant authorities (including the National Center for Missing & Exploited Children or applicable local bodies) and permanently terminate the associated accounts.

1.3 Non-Consensual Intimate Imagery

You must not create, request, or distribute intimate, sexual, or sexualized imagery of any real person without that person's explicit consent. This includes "deepfake" intimate imagery, face-swapped nudes, and any depiction created from a real person's photos.

1.4 Illegal, Harmful, or Abusive Content

You must not generate, upload, or distribute content that:

  • Violates any applicable law or regulation, or promotes illegal activity.
  • Constitutes child exploitation, human trafficking, or exploitation of any person.
  • Promotes or depicts graphic violence, torture, terrorism, or extremist content.
  • Constitutes harassment, bullying, defamation, hate speech, or incitement to discrimination or violence against individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Invades another person's privacy, including the disclosure of personal data (doxxing).

1.5 Deceptive and Misleading Content

You must not use the Service to create content intended to deceive, defraud, or mislead, including:

  • Deepfakes or manipulated media depicting real people saying or doing things they did not say or do.
  • Impersonation of real individuals, public figures, or organizations.
  • Disinformation, including fabricated news imagery, forged documents, fake evidence, or manipulated political content.
  • Scams, phishing material, or content designed to facilitate fraud.

1.6 Intellectual Property Violations

You must not generate or upload content that infringes third-party intellectual property or personality rights, including copyrighted characters or artwork, trademarked logos, or the name, image, or likeness of real people used without permission.

2. Prohibited Conduct

You must not:

  • Attempt to bypass, disable, or evade our content moderation, prompt screening, safety filters, or blocklists — for example by using obfuscated spellings, coded language, prompt-injection techniques, or iterative rephrasing to obtain prohibited content.
  • Circumvent rate limits, credit systems, authentication, geographic restrictions, or any other security or access control.
  • Use automated means (bots, scripts, scrapers) to abuse the Service, harvest outputs at scale, or create accounts in bulk.
  • Reverse-engineer, decompile, or attempt to extract the source code or model behavior of the Service, except as permitted by applicable law.
  • Use the Service, or its outputs, to train, fine-tune, or benchmark competing AI models.
  • Interfere with, disrupt, or overburden the Service or its infrastructure, or probe the Service for vulnerabilities without authorization.

3. Moderation and Enforcement

  • Automated screening. Text prompts may be automatically screened before generation. Prompts marked flag or deny are blocked before the model is called and before credits are charged.
  • Human review. We may review prompts, uploads, outputs, and account activity — manually or with automated tools — to enforce this AUP, comply with law, or respond to reports. We retain safety-event records as needed for enforcement.
  • Consequences. If you violate this AUP, we may, at our sole discretion and without prior notice: remove or block content; reject generation requests; suspend or permanently terminate your account; cancel subscriptions; and revoke credits. No refunds are issued for accounts, subscriptions, or credits terminated or revoked due to AUP violations.
  • Reporting to authorities. Where required or appropriate, we report illegal content and cooperate with law-enforcement and payment partners' investigations.

4. Reporting Violations

If you encounter content or conduct that violates this AUP, please report it to support@banana-image.net with as much detail as possible. We review all reports and take appropriate action.

5. Changes to This Policy

We may update this AUP from time to time. We will post the updated version on this page and revise the "Last updated" date. Material changes may also be announced through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
